Types of Title Deeds in Kenya:
1.Certificate of Lease– Issued for leasehold property (max 99 years). Mostly for urban plots, especially in cities like Nairobi and Mombasa.
2.Absolute Title (Freehold) – Gives the owner full, indefinite rights to the land without conditions. Common in rural areas.
3.Sectional Title Deed – For apartments or units within a shared property like flats.
How to Obtain a Title Deed in Kenya –
Step-by-Step Process
Step 1: Land Search
Do this at the local registry or depending whether that registry is digitized
Step 2: Land Transfer Documents
Work with a lawyer to get:
-Rates & Rent Clearance Certificates
-Land Control Board consent (if needed)
-Sale Agreement
-Transfer forms & ID copies
-Payment of stamp duty (4% urban, 2% rural)
Step 3: Property Valuation
Government valuer inspects the land to assess true market value.
Step 4: Pay Stamp Duty
Pay via KRA iTax & submit for franking (proof of tax paid).
Step 5: Land Registration
Lodge documents at the Lands Office. After about 2 weeks, you’ll get a new title deed in your name.
